Best accountancy firms for LTD in 2023 - Contractor in tech - Outside IR35

I would agree but as you said it's very complicated to interpret the "how" and this where you have the most arguments. In my case simply reading ESM 10010 it poses warning...so no need to look further. The chain simply does not work. ESM 10010 Rules details "who you should consider to be your...

Best accountancy firms for LTD in 2023 - Contractor in tech - Outside IR35

Not sure if you have seen my last post on the other thread but I really got into the details of the offer (contract relationship based) and IR35 rules. I don't feel the way the "consultancy" wants this to work is compliant enough i.e contract wise it "might work" but in practice the "how" the...

Best accountancy firms for LTD in 2023 - Contractor in tech - Outside IR35

So now that I got replied after challenging the accountant answer : He has now revisited his opinion and after "double checking" he agrees with the liquidator than capital distribution date is effectively the reference date for the 2 years count down. That comfort my initial decision to change...

Agree with this but as lot would say here, when you have a business as a director you should learn the ropes and ask questions about tax planning and tax efficiencies. That's the way I have operated in the past, searching and then asking the accountant. Then you need to make sure you have the...

New gig sold as outside IR35 - how to make sure this is the case ?

I always refuse to wear company s** clothing/stuff... So no issue on this side anyway. And doubt they have anything anyway since company size might be less than 10 people.....

New gig sold as outside IR35 - how to make sure this is the case ?

And I can confirm it's sticky after reading the ESM10010 again and again. Not sticky regarding autonomy as I clearly will have no supervision neither control. The main concern is the consultancy company trying to make this work as a contracted out service whereas I will be mainly interacting...

New gig sold as outside IR35 - how to make sure this is the case ?

Spoke with both consultancy and consultancy's client. In my field everything the consultancy's client does is outsourced via managed services. So they have no one including PMs that could manage this on site. And it's not a project with a framework and a team etc... That bit is the sticky point.

New gig sold as outside IR35 - how to make sure this is the case ?

Actually as I just updated on post in section role it's not the typical role you are thinking of where you are part of a project team etc...There is no PMs nor client supervision. They do not have anyone on site that could do this job or supervise it. So to me this part looks fine as it means I...

It helps. I have updated the role section with more info to explain the how. Not sure if something missing.

New gig sold as outside IR35 - how to make sure this is the case ?

As I think you were offering with this reply one of the best compelling answer to my vague initial post (sorry) here is more details following a call with the agent from the consultancy. So: The consultancy is a supplier for the end client (large). Agreement is a SOW. (Not sure it's my business...

Yes I said "maybe" so that's an assumption on my side so until I got anymore details from him no point talking more about this.

Almost agreed on everything. Even the fact that I should have got more details before posting as It would have helped everyone. But I strongly disagree on tone sometimes used by certain person here and there are no excuses for that whatever happened in their past life. We all have luggage’s and...

Best accountancy firms for LTD in 2023 - Contractor in tech - Outside IR35

Agreed it can be annoying to get non sense questions from newbies all the time. Especially from those that are not trying to learn. How do you distinguish them from those who want to learn though ? By interpreting only what they wrote ? Is that a viable assessment ? Questionable IMO... Then for...

Sure thanks for the tips. Also aware about the multiple capital distribution dates impacting the 2 years count down. I think the accountant is wrong but maybe he sees a different risk. And this thread is drifting away anyway. I understand why you are getting nervous with the non regular users.
