That is a very good point and something I had overlooked. A contract update to reflect an MSP arrangement kicks IR35 well out of the picture in that respect. It's so close to being that already given what I provide them with I can't see the client having any issues. Depends how serious they are...
Yep - I agree. Which is why in all the years I've never attended the Christmas party, staff meetings, internal strategy presentations or any of that stuff. If it's staff only I politely make my excuses - they think I'm a bit odd and a social outcast but I've paid my mortgage off. I can live with...
I've downloaded the IPSE guide to IR35 to refresh my memory and got an appointment with my accountant.
A thought is that the client needs (rather than simply wishes) me to be here so it's perhaps not as controlling as first thought - it's not as if all the work I do can be done from home so the...
Yep, it's my problem. I can take on someone to work alongside me if I want to but given the clients eventual move to permie land it's probably not worth it. If they were not doing that then yes, that would be the solution.
Yes but but it's not that black and white. If I'm ever deemed to be inside IR35 then I could get a tax bill back over 11 years! So, leave with a warchest or take the £70k because it suits me right now whilst I look around for something new.
Oh yes - they changed their name. :smile
I do have IR35 insurance so I'll have to check and see terms and conditions as whilst they will cover any liability I can't imagine if the relationship is clearly within IR35 one would still be covered as your risk profile has changed.
It's more about any repercussions from HMRC if I switch the gig to permie and if I don't the ongoing risks (if any) whilst the client makes their switch to permie.
I'll have a chat with my accountant and also PCG which should clarify further.
They can but everyone needs time off for family or something or other. It's unrealistic not to anticipate that and for them, for their own business sake not to have other provisions.
I could solve it by taking someone on which gets round needing to go permie with them.
I've been there 10 years and my business has been up and down with other contracts in parallel. I also sell products (servers, laptops, online backup) and services to the client so not just my presence on site.
If I'm well and truly inside IR35 then the switch to perm with the client regardless...
Over Christmas I told my client (£500 + £4kpm in managed services) that I wouldn't be in the office for a few days. In the past this has been ok but now after many years the client refused and told me I had to be there and in future to ask permission for time off.
It's an excellent gig and the...
Spoke to BDO the other day. They are of the opinion that creditors will not see a penny because the debts are too great. I asked them about the client who had a ton of unpaid invoices and they said they are not aware of this.
The contracts were sold (so I understand) to pay off RBS. Now we all...
Unless you signed your opt-out before you met the client then you are almost certainly opted-in and so free to go direct if you like.
My opt-out form was sent to me months after working for the client and I have been advised that I am opted-in and so the clause itself doesn't hold.
Let's not...
