    Contract position

    Hi,

I am currently working as a temp through an agency. My contract with the agency finishes in a few weeks.

I have been approached by my employer to apply for another role within the company. Note that the position is in a different department and is a contract position as opposed to a permanent position.

Am I bound to the agency for this next role? Or could I contract with my employer directly and thus cut out the agency?

    Thanks

depends on the precise wording in the contract. I imagine they will have covered this though and you can't do it.

No it doesn't. It depends upon whether the contract conforms with the requirements of "the conduct of employment agencies Act 1999".

If it doesn't, then the contract is a piece of scrap paper that can be torn up and the terms of the act will apply.

If it does, then um, the terms of the act will apply.

So either way the answer will be found in:
