West 28th Street Limited

3.75 star(s)
I can't imagine West 28th, Trethowans or Ethica thought that the FCA would get stuck into this in the way they have. Someone at the FCA clearly is not impressed.

It's hard to see why Trethowans would want to be involved in this. I thought it might be a bit of a profit share, but I've been told that apparently a law firm can't really act in that way......although I don't know if that's true or not. If it's not that, then their now involved in some bad news stuff that really isn't a good look for a supposedly reputable law firm.

I bet Ethica are a bit worried too now. The FCA can pull their licence at the drop of a hat, so this now puts them firmly on the FCA radar......which isn't good for them.

I think there are 6000 people affected? their next step is probably applying for a validation order so keep sending any useful evidence to the FCA please. What we have all been doing in the last few days has worked. These were never loans. End of

Yes but I think they are planning to send court claims to 3,028 people not all 5,754 plus FCA has placed the following restrictions:

6. The Firm must not demand payment from any Relevant Individual who is named as a defendant to the Court Claim unless and until the sum claimed is legally due and recoverable following determination by the court and the grant by the Authority of any Validation Order required in respect of the relevant agreement.

7. The Firm must ensure that any person acting on its behalf does not demand payment from any Relevant Individual who is named as a defendant to the Court Claim unless and until the sum claimed is legally due and recoverable following determination by the court and the grant by the Authority of any Validation Order required in respect of the relevant agreement.

I would love to be a fly on the wall in Thompson's office, or wherever that rat is. I don't think this is panning out how they planned at all. Let's see what news we get next. This will be a very lengthy, complicated and costly thing to pursue. Rats

So the FCA's intervention raises an interesting question. If the regulatory and legal issues surrounding these purported loans are now being examined, it would be surprising if the underlying documentation wasn't subject to scrutiny.

Many of us have been asking for the same core documents for months through SARs, CCA requests and dispute correspondence:

  • Original agreements
  • Assignment documentation
  • Evidence of loan advances
  • Lending authorisations/registrations
  • Audit trails and portal records

Given the FCA position, I'd be very interested to know what documentary evidence has actually been provided to support enforceability. That is if they have applied for the Validation order.

Given how often people have been directed to "the portal", perhaps they'll just send the FCA a portal login and tell them to help themselves. 😄

Does this mean they can continue to pursue people not named as a defendant?

Return the form and list arguments - Enough to reason, NOT DETAILED as that will come later.

4 RESPONSE BY THE DEBTOR
4.1 The debtor should use the Reply Form in Annex 1 for their response.
Thedebtor should request copies of any documents they wish to see and enclosecopies of any documents they consider relevant, such as details of paymentsmade but not taken into account in the creditor’s Letter of Claim.

4.2 If the debtor indicates that they are seeking debt advice, the creditor mustallow the debtor a reasonable period for the advice to be obtained. In anyevent, the creditor should not start court proceedings less than 30 days fromreceipt of the completed Reply Form or 30 days from the creditor providingany documents requested by the debtor, "whichever is the later".

4.3 If the debtor indicates in the Reply Form that they are seeking debt advice that cannot be obtained within 30 days of their reply, the debtor must provide details to the creditor as specified in the Reply Form. The creditor should allow reasonable extra time for the debtor to obtain that advice where it would be reasonable to do so in the circumstances.

4.5 A partially completed Reply Form should be taken by the creditor as an attempt by the debtor to engage with the matter. The creditor should attempt to contact the debtor to discuss the Reply Form and obtain any further information needed to understand the debtor’s position.

8.2 Where the debtor has responded to the Letter of Claim but agreement has not been reached, the creditor should give the debtor at least 14 days’ notice of their intention to start court proceedings, unless there are exceptional circumstances in which urgent action is required (for example, because the limitation period is about to expire)

Is there a real limitation period issue this or clever way to issue GLO without notification for there S127 appeal.

I am not a lawyer, accountant and facing the same BS we all are. I would suggest you read

Key UK Law Sites
    • Legislation.gov.uk: Managed by The National Archives, this is the official home of UK statute law. It contains revised and as-enacted primary legislation (Acts of Parliament) from 1267 onward and secondary legislation (such as Statutory Instruments) from 1823 onward.
    • The National Archives (Find Case Law): The National Archives hosts Find Case Law, an official, free public repository for court judgments and tribunal decisions from England and Wales (expanding to replace or run alongside traditional sources).
    • BAILII (British and Irish Legal Information Institute): An independent, non-profit institute (BAILII) that has long provided free access to British and Irish case law and legislation. While the Ministry of Justice partnered with The National Archives to create a central repository for court judgments, BAILII continues to operate and publish judgments from various courts, tribunals, and jurisdictions across the UK and Ireland.

Do not prejudiced your defence or make assumptions.
One day this might be finally over and I think there going to get a shock if they ever do get me into court.
But more than likely drop it before it cost them more money 🤣and risk costs.
