For those that haven't joined a group though, their case will never go to the FTT. So no refund will ever come, as there's no way to issue a follower notice to HMRC.
I was a director of my own Ltd company and the EBT was arranged for that Ltd co. The NICs were class 1.
This week I was sent a county court claim form for NICs. They've added over £10k in interest and £4k for court fees! Am I the only one being chased for NICs?
I don't know what type it was, but they just sent me a letter informing me that they're lodging a claim with the County Court to protect their position with regard to NI contributions. They already did this for the PAYE some time ago.
That's interesting. The first tax demand they sent me (a year or two ago) included a NICs payment of around £90k. Since then the figure they've been quoting is for income tax of about £210k. So I'd assumed the worst case scenario of £300k plus interest, but they've not mentioned the interest for...
Why bother? Now they have APN's they don't have to prove anything. If they lose again and finally in this case, it's not like they're going to issue follower notices and give us all a refund.
I think this is exactly the way HMRC see this going. Issue the APN, take the money and either you have no funds left to fight or you don't have enough to gamble on something you may well lose.
Leaving the UK and living on a beach somewhere is looking more appealing by the day.
In the case of a contractor, who would they send the APN to, the individual or the company? What happens when your company is no more eg. A contractor that's gone permie.
My settlement amount is close to £300k before interest, if I didn't live in the UK they wouldn't be getting a penny. What can they do if you've left the country?
