  1. Q

Time for MVL or not and IR35

Out of interest, which company is the insurance with? PCG/IPSE?

IR35 - Leaving a contract without SDS - back dated compliance investigation?

Does the amount of time that passes make any difference? For example if you returned for the phase 2 project in 3 months time? or even in a years time? Surely then past contacts couldn't be linked, as it is not the behaviour of a disguised employee to work elsewhere for months/years?
  3. Q

Time for MVL or not and IR35

If he closes his company down via MVL or struck off then once it's closed isn't that the end of any potential investigations? If not then there must be a fixed time window that any investigation could occur within otherwise you would need (IR35) insurance forever!

Time for MVL or not and IR35

If he took the MVL route, for how long could he get insurance for? Until the MVL is completed finished?

IR35: Planning for April 2021 – should I stay or should I go?

BlasterBates and jamesbrown - thanks for the detailed debate. There's lot of info in there for me to digest. I think at this point in time I'm going to finish with the client, and ask my contractor friend if he wishes to assist them alone.

IR35: Planning for April 2021 – should I stay or should I go?

Thanks for this thread cojak I've been working for a client for a few years, and had all contracts checked by QDOS and deemed outside IR35. My current contract is due to finish this month and I plan on finishing there. There's never been a SDS, and they're fairly IR35 clueless. A contractor...

    Pre-payment before April 2021?

Why not? Does the contract have to explicitly say when the work will be carried out? I thought the whole point was to aim for a deliverable (i.e. support coverage) rather than dictate when and where.
  8. Q

    Pre-payment before April 2021?

Hi, If a client ordered and paid upfront for a block of work - let's say support coverage - before April 2021, and then have it carried out at any point in time (March 2021, April 2021, May 2021, etc). Would this get around the IR35 April 2021 changes? I know it's a short term fix, but could it...

    IR35 - Outside to umbrella

If Self Employment was an option Vs umbrella, what are the pros/cons?
  10. Q

    IR35 - Outside to umbrella

If I went outside IR35 to umbrella (like the OP) then I would close my company down, but was surprised to find I could not go back to a new company quickly.

    IR35 - Outside to umbrella

So I enquired about closing my company and was told I can't open another (doing similar work) for at least 2 years. So no quick return to contracting unless it's via an umbrella!

    Inside IR35 & I Want to Stay

I'm new here, but I would assume NO, otherwise everyone who was nervous would close down their company asap! The tax liability is yours personally.
  13. Q

Fixed price project work from April 2020?

Sounds like you've got a good situation and I hope it continues to work well for you! I've got the first two, so just need to get them on board, which I'm sure they'll agree is easier than finding someone new.
  14. Q

No status determination and final payment after 06/04/2020

Could you bill up-front for March work in the Feb invoice? Is it not an option if you're friendly with key staff? That'll be paid in 30 days so won't be a problem.
  15. Q

Fixed price project work from April 2020?

Thanks for all of the great input! :happy I've worked with this client in the past so I'm fairly comfortable in estimating/bidding at a fixed price with them. As others have said I may bid under/over and one side will "win", but I'll take that over jumping into a permie role elsewhere. At least...
