what happens...
1- if PS end client says everyone inside ir35 (blanket decision no ifs/buts) ...
2- PS contractor agency ABC says to contractor, leave or inside/PAYE/umbrella options etc....
3- Another agency XYZ says, come with us, we will get private...
All in all, it simply encourages and give hope to more people to carry on tax evasion which is exactly what the hmrc wants to stop in the first place. Poor suggestion and least likely to get even recommended or heard at higher levels.
Tax amnesties in any form usually carry bad reputation and...
Red flag is one thing, getting invoked at an hmrc system is another. What do you think the risk of such contractor to FTC cases flagged & invoked post April changes ??
surely umbrella/inside ir35 and PS/inside/outside ir35 got more chances of flagged and invoked at hmrc system as both options...
One should also not forget, we may only have limited time to do traditional contracting at private sector too. So if someone do have the capability to leave PS and join Private, then must avail the opportunity.
I see there is a global and persistent drive to retreive taxes from an individual...
so far, somewhat, somehow, maybe, ifs/buts aside, partly guessing...
Best *PS only* options are:
1- If same PS - then fixed term/perm employment to avoid retro
2- If different PS - then can even do umbrella (inside ir35)
go permie ? you mean in same PS organisation ?
fully invested, so warchest cannot be readily available which is really unfortunate cuz never saw this coming !!

Case Study:
A PS contractor who has 5 years in same PS contract want to continue in same PS contract after Apr 17 changes. He wants to avoid or atleast minimize retro investigation possibility but at the same time cannot afford losing job just right now. He is not the...
How will HMRC identify such cases in the first place for retro investigation ?
What exactly happened at BBC ?
Permanent/fixed term employment completely detaches you from the LTD company structure, and in absense of LTD company there should be no scope of ir35 to apply i guess... Do you think...
safest options ?
safest options ?
I wonder whats the safest option or possibilities for the not-so-brilliant-and-brightest contractors, who do want to keep working for same PS contracts after April 2017 changes.
I believe the options with associated risks are:
OPTION # 1
Permanent/Fixed Term...
Private.. when ?
Private.. when ?
Any intelligent guess how long will it be before it may get implemented in private sector ?
I hope it is not implemented so soon like next financial year. In that case not worth a lot of hassle for PS contractors dumping PS contracts and moving into private...
why left out private ?
why left out private ?
any good guess how many months or years before the same will roll out to private sector ?
There is no point jumping from public to private if lets say the same is implemented for private sector in the next financial year !!
why left out private ?
why left out private ?
I am really somehow puzzled why govt/hmrc did not roll out same regime for the private sector ?
did they do it on purpose ? i.e. to roll at a later stage.... i.e. divide & conquer
or did they never want to implement this in private sector...
Is...
