I think the best option maybe to go perm and try and cross train into a different role. The problem is most roles are bobable you just need to try moving into a position where you can achieve more differentiation.
Unfortunately, you might be chasing a lost cause. Contracts often state that if there is no work, agency is not obliged to pay you, regardless of whether the contract is signed. Its a hard lesson but I would as they say keep looking until bum on seat. I suspect the agent kept you out of the loop...
I was on the bench for about 2 months and was thinking long and hard about going perm, then I got lucky and two offers came along. Keep plugging away guys, these are tough times and the extra bench time people are experiencing is not uncommon.
Thanks for the informative replies.
The suggestion of reviewing my salary was an option I hadn't considered. Judging by the the responses so far, it does sound like substitution is not as common or clearcut in working environments requiring security. Speaking with client, they have already said...
I think thats why they have turned down my requests for contract amendment and out right said that they won't accept a substitute (despite having a sub contact clause).
Anyway I shall watch a few more re-runs over only fools and horses and see if that 'he who dares' is in me.
I'm unlikely yo envoke a substitution clause however not having one probably wont do my any favours with an IR35 investigation.
I've requested that the sub contract clause be modified to a more unambiguous substitution term as suggested by QDOS however they have rejected the changes.
Thanks...
Quick question. I have had a contract reviewed and it failed straight off the bat for not having a clear substitution clause. The contract mentions the ability to subcontract but says it was at the discretion of the company. I've spoken with the client and they have said it is not possible to...
I think you should go for the 4 week contract. Even if it doesn't sound like a extension is on the cards, if you make a good impression, who is to say they won't contact you (or the agent) about a new longer contract. For me it would be about making contacts and more importantly billing, rather...
Thanks for the detailed response Wanderer. I have my own Ltd company and thought you point about leaving the clause in as an indication of being outside IR35 was a very valid point. Unfortunately, this agent is not REC registered so I think this has given the them the opportunity to add some...
Hi, I have a couple of quick questions for everyone. In the agents T&Cs is the following:-
The Consultancy accepts that agent x has the right to offset any losses sustained as a result of the Consultancy’s
actions, breach or unsatisfactory performance from any payment due to the Consultancy.
I...
