    BN66 - Round 2 (Court of Appeal)

I was afraid of that, I guess we'll just have to see if Parkers comments about HMRC recognising hardship hold any water. I somehow doubt it!

    BN66 - Round 2 (Court of Appeal)

One thing I found interesting was the reference to jointly owned assets. Everything I own e.g. house, bank accounts is actually jointly owned between myself and my wife and has been for over 20 years of (fortunately still despite all this) happy marriage. For any HMRC observers I'm not...

BN66 - Time to fight back (Chapter 3)

I've found that agencies "accredit" a certain list of Umbrellas (the usual suspects Giant, Orange Genie etc.) and the choice given was use them or go Ltd. The distinction wasn't to do with self-employment or employment more the identity and perceived type of the "management copmany". Having...

BN66 - Time to fight back (Chapter 3)

The MSC legislation seems to have spooked a lot of agencies. I left one contact a couple of years ago because the agent would no longer deal with MP at renewal time. I have recently had the same issue with my current contract (different agency). This time I decided to stay put and go back Ltd...

BN66 - Time to fight back (Chapter 3)

The point I was trying to make was that as most if not all of the people using the MP scheme did it because of IR35, so I expect writing to the originator of IR35 will just get short shrift. As far as this government goes I'm sure their attitude will be somewhere between "Couldn't care less" or...

BN66 - Time to fight back (Chapter 3)

As I recall it was Stephen Timms who was largely responsible for IR35 in the first place. Whether he just has a rabid dislike of contractors or whether it had anything to do with him being a director of OVUM I wouldn't like to say, but I can imagine what his response to any letters might be.

BN66 - Time to fight back: Continued

You might not get the choice as a lot of agencies are refusing to deal with MP or MTM after the latest round of government intermediaries legislation. I've just been contacted by my agent to say that my contract will end in December if I stay with them. I doubt the end client with sanction an...

BN66 - Time to fight back: Continued

As far as I know although the retrospection went back to 87 HMRC are only looking back to 02 because they are only interested in us. I think MP are pretty much on their own as far as the JR goes.

BN66 - Time to fight back: Continued

Firstly referring to a couple of earlier postings I think that there are far more of us than the 25% with no savings facing total ruin. I'm in the offset mortgage camp but it won't nearly be enough. When faced with the stark choice of ruin or optimism it isn't suprising that many of us plump...

BN66 - Time to fight back: Continued

Judging by the recent postings I think I'm getting an answer to my question whether or not it is good idea to redeem the offset mortgage or not.

BN66 - Time to fight back: Continued

Although you weren't replying to me directly I feel compelled to reply - the answer being a definte Yes. I started contracting in 93 and quite happily adhered to the ltd. company / dividend model. Admittedly this did lead to certain Tax advantages and it was possible to minimise the top level...

BN66 - Time to fight back: Continued

It is also becoming increasingly difficult to find agencies that will deal with MP so the choice might be removed anyway. I've kept my old company going just in case but after the Dragonfly ruling escaping IR35 and the revised S6660 when it comes in just doesn't look possible. I don't know...

BN66 - Time to fight back: Continued

Hi TAF4, It may have been my "can't be more bankrupt" quote you are thinking of. I'm in a similar position to yourself although I happily ran a Ltd co from 93-03. After a couple of years of struggling with IR35 issues and with S660 on the horizon I decided that there had to be a better way so...

BN66 - Time to fight back: Continued

Offset Mortgage, ISA's and a few other obvious legal (currently!) methods make the best of the gross vs. net tax. As for the paying X now as opposed to X++ later its more like lose house now or lose house ++ later so there is not much option. I wonder if the poll results are a bit skewed into...

BN66 - Time to fight back: Continued

I know peoples circumstances are different and can fully understand why the more cautious amongst us want the level of protection a CTD can offer but is it really worth it? I would reckon that average most of us will "owe" is roughly £30K per year we were members of the scheme (apologies if...
