Churchill Knight & Boox clients being investigated as Managed Service Companies

Maybe I'm missing something but contractors deciding to leave their accountant and doing their own accounts and only asking their accountants to do their CT returns and YE will still be on HMRC's radar if their accountant is being invested as a MSCP. HMRC won't know if you are paying your...

Churchill Knight & Boox clients being investigated as Managed Service Companies

All they will need is a couple of lead cases and the rest of them would be linked to them. I'm not sure how many clients but if there are 1k then there would have to be some kind of association where you contribute towards it. I think you are talking about some hefty sums and if you settle for...

Churchill Knight & Boox clients being investigated as Managed Service Companies

So in 3 years the best arguments they could come up with were the ones mentioned above?? Those flimsy arguments could have been drafted in 5 minutes! I reckon originally there must have been more to this but maybe after digging there was nothing but after investing 3 years of resources they...

Churchill Knight & Boox clients being investigated as Managed Service Companies

Just been following this thread with interest and sorry to hear everyone who is mixed up in this mess. My take is that CK and Boox must have been having conversations with HMRC for quite some time on this. I saw an earlier post that someone wasn't able to close their company in 2019 but I take...

Instead of paying fees to Ambulance Chasers...

Isn't he also the key adviser to LCAG and the Loan Charge APPG? When this gets out wouldn't his harm their reputation and possibly hinder all the progress they have made to date? I'm sure they must be aware of this link as there is no hiding it. Thousands of people are relying on both these...

    AML and the outstanding APNs

I could be wrong but I thought if there are penalties attached to your outstanding APNs that even when you settle you will still have to pay this on top of your settlement calculation.

What is the 2019 Loan Charge?

I would question if they had the loan written off but also more importantly what they've told HMRC on that form you need to fill in. Of course you don't have to have the loan written off to settle but if you do you need to inform HMRC.

What is the 2019 Loan Charge?

There is no nil rate band available for exit charges from EBTs for pre DR loans (pre 2011). There is a nil rate band for post DR loans. (post 2011) IHT is 0.25% per quarter.

Pension contributions can be used to relieve LC19

But it would still be considered in HMRC's eyes another payment on account... the case is still open as they will argue that you should be taxed on fees which only a tribunal could decide and I find it unfathomable that a judge could rule on something that HMRC nor the individual could be 100%...

    HMRC loses big avoidance case

The article says 'he invested in a tax avoidance scheme' so could have been a film scheme etc. No mention of loans so I think Mr. Tooth should be drinking a lovely bottle of bubble this evening as he has dodged a £400k bullet!

What is the 2019 Loan Charge?

Well said it was definitely not an oversight that there was no mention of Rangers for CLSO2 when you compare this to CLSO1 they mention the Boyle case a number of times and that was only a FTT case so there is no case law that can be created. If the Rangers case went the way the wanted they...

What is the 2019 Loan Charge?

I agree that HMRC should have written to everyone about CLSO2. For CLSO1 they wrote to everyone who had an open enquiry to let contractors know about this 'opportunity' to settle. (which was a result of Boyle!) They launched CLSO2 back in November and there has been nothing but I get the feeling...

HMRC Enquiry letters on Loans from EBT and other schemes

+ 1 I was speaking to someone who was STILL on a loan scheme and he told me straight face that the accountant told him that if they lose in litigation that he will get ALL of his money back paid in fees. It didn't matter of course that the scheme promoter was in Mauritius..:eek
