You mean we will finally have a name to whom we can assign costs too?!! :)

I think eek is implying this would then fall under unregulated loans. So they could take you to court as an individual outside of any CCA and use standard contract law. This, from my limited research, is by no means an easy route for them. Jumping from saying regulated to unregulated is...

Thats a good question. Has anyone engaged a solicitor (away from the groups we know about) who has had any success in a full personal response?

Unfortunately this is a weakness in the system in that if you dont reply to anything, or don't attend court, the court will likely award the plaintiff. And if you dont dispute the plaintiff whats stopping the plaintiff presenting any story to the court, or half truths or worse. So protect...

This. Clearly we were mis-sold. Lured into an EBT scheme, only to find out it was a scam all along. Follow the money (our salary) and its clear what this actually is.

Glad I spent my time over the weekend in submitting a thorough complaint to the FCA. I specifically brought to their attention the two recent letters (sent by Trethowans) stating CCA and the Validation Order content. I received positive feedback this morning, and going by their update today they...

Yes do as you say. Write the email followed by hard copy and state that a hard copy is on its way in the email, date both today and that will be fine.

This is quite the defence. The judge shall be made aware of this (if it goes that far) and this is excellent evidence for the FCA against any attempted validation order. Trethowans are going to be deeply embarrassed for getting involved in this. Going to look into counter claim, costs for...

Thats a useful archive. Illustrates the schemes in which we were lured into, archives like this will be useful when demonstrating the money trail to the judge. 'Following the money' will be key for the judge who shall be made clear, from the outset, that these were never loans to be repayed, not...

Yes. Your alleged debt is now statute barred. You need to write to them and tell them this. If they keep sending letters threatening court this will amount to harrasment.

From THL in an email on Feb 2019 (a snippet) "To benefit from the present favourable terms, so that you only need to repay 5% of the outstanding balance, please log into our portal now." And at the end "You will need to obtain draft deeds for signature on or before 1st March 2019 if you want to...

Can anyone summise why would West 28 mention Elysium Law? Or putting it another way what benefits West 28 by having more people join Elysium Law?

Things about to get very serious and much more real? / Felicitas Letters

They (Felicitas) didn't make take a penny from me. I did take something from him, however. Andrew William Thompson. I don't think this has the legs to continue.

    Loan charge

I was involved with Sanzar but thankfully have settled all years with HMRC! I have skimmed through the case document and clearly HMRC raised the discovery within four years so a valid claim by HMRC. What is the difference between an assessment and a discovery?
