It looks like Capita have completed their assessments of the CLone workers. Agencies are starting to get in touch with Contractors letting them know the result. As far as I am aware they have all been "Inside" so far
I know one part of Capita sent out a letter to all of its contractors. I didn't say anything new but included an email address in case people had questions.
I understand that they were expecting determinations from PSBs by 10th March. A date that probably assumed the ESS tool would be...
Having seen the letter referenced by the cited MOD article I can confidently say that it had nothing to do with the upcoming changes. It was almost identicle to a 2016 letter.
Also assumes that HMRC cannot get their mitts on the evidence public sector bodies are required to produce to demonstrate tax compliance of their off payroll engagements.
I don't expect that there is a centralised list so will likely be too much hassle for them
My initial cynical thoughts at the time were "how can I boost my spend on goods to >£1000?" so that the new rules don't apply. Will be getting proper advice from the accountant before making a decision.
I know that they persisted with the BETS even after the gov website said that they should not be used. I believe they that have stopped now but it would not suprise me if some sections of Capita still asked for them.
From the letter it looks like they intend to take inside/outside direction...
Have just seen a letter e-mailed from Capita to their contractors. It talks through the changes and links to the gov.uk pages. It looked pretty good for Crapita from a quick scan. No new information. They did provide an e-mail address in case of any questions :laugh
Please note that the public sector are required to do this anyway and that it may have nothing to do with the off payroll reform.
From the technical note:
3.Off-payroll working in the public sector tax legislation is separate from Treasury procurement rules which apply in central government...
In theory you could take control of "fee payer" responsibilities under the regs. Write to the fee payer to be saying the "worker" has left the company and has joined a new company has been subcontracted and services will continue as normal. Assumes an unfettered right to substitute/subcontract...
From the technical note:
As things stand the employment tribunal is an interesting angle. I would guess you would have as about much success as BOS brolly contractors under SDC would have at the moment. The technical note (para 37 and 51) indicates that the intent is that "PSC"'s don't get...
As others have said, very hazy at the moment, doom etc. Also:
1. If your planning to get out - speak to the agency to make sure the last payment is made prior to the 6th April. I imagine some agencies would make early payments if it avoids the new rules.
2. If the contract goes out beyond...
