    Umbrellas and SDC April 16 onwards

    I'm aware of the travel and subsistence changes.

    Sorry if I have missed it but can anyone tell me what is happening with supervision, direction and control post April 2016¿ I read online that it will need to be decided between the umbrella and client to determine IR35 status and the default position will be inside IR35?

    IR35 doesn't and never has applied to brollies.

      Ah, so the SDC refers to not being able to claim T and S and is nothing to do with IR35 ¿

          In summary, if you are working through an employment intermediary you are deemed to be under SDC and each engagement is to be treated as a separate employment. Confirmation as to whether there is any SDC will need to come from the end client, as they are the person that you will be performing the work for. It would be pretty much impossible for the intermediary to be able to declare the status for each assignment. The guidance on the "definition" of SDC is likely to be published at some point between now and April 2016, which we hope will provide clarity, however if you want to have a look at the basics that they are pinning this on take a look at the examples in the following document; https://www.gov.uk/government/upload...t-guidance.pdf under EIM 80500 Page 6/7.

            Yep the SDC is the test to see if a contractor working through a brolly is eligible for T&S relief. The IR35 changes are likely to be consulted / acted on next year.
