Claiming back employer NI from agency/umbrella - worlds gone mad!

How on earth can you bleat years down the line that you've got a massive tax bill because you shouldnt have had to pay the employer NI? (its taken at the time anyway).

Because you haven't been paying it for years - the guidance to which you refer is for public sector workers who have been moved inside IR35 without anyone looking at the contract and seeing what it should say and what it actually says, and what the legislation says must happen.

Inside IR35 should always be advertised giving you the net rate, but I doubt many agencies / umbrellas / clients realise this and they don't recognise the guidelines from HMRC that say that one of the benefits that the public sector change brings is that employers NI is met by the engager.

Time to set up a brolly where the fees are higher and proportional to the agency payment, but the employers NI cost is born by the brolly...

Completely different. When I started contracting the rules were no work, you can claim JSA, nothing has changed. With the idea of trying to get back the employer NI - this is something most people know damn well at the beginning they've got to pay.

At the end of the day though, lets not start the JSA thing again? If I want to claim I will, if you don't want to don't... Simples.

So you sign a contract and go through an umbrella. You know full well that you're going to be paying employer NI. First payslip confirms this.

Sadly when it comes down to a question of money you will see everyone and anyone try to claw money back even if it is near wafer thin probability of even seeing a single penny.
