    HMRC Compliance Check Worries

    Hi Folks
    Hope you can help.
    I am under random compliance check.
    I am working for a large uk company through an agency via a payroll company.
    HMRC are doing a compliancy check on me.
    I have been claiming my travel expenses as per the usual rules (at least I thought)
    HMRC are telling me that because I work through an agency that I cannot claim travel expenses and I owe them over 2 grand in tax for 2009-2010.
    I have never been given a contract of over 2 yrs and thought that this was claimable but they are telling me not.
    I am through an umbrella company.
    They are now looking at previous yrs. If my claim is dissalowed then I think this will finish me off
    Always payed my dues for the last 25 yrs and never claimed anything back.
    Any help appreciated

    Can you post the actual accusation from HMRC in more detail. The devil is the details here and generalisations won't allow us to help you accurately.

    Have you also checked the terms of travel from the payroll company in great detail.

    It is NOT the contract that counts for the 2 year rule. It is 2 years in a LOCATION. Give us a break down of your locations and breaks in the last 4 years or so. If it is the Sq mile in London you could be in trouble.

      2009-2010 was the yr in question.
      I started with this particular contract in April 2009. therefore was the first yr.
      It is in various location but mainly in the Derby area.
      Never worked through an agency before!

        When HMRC asks you specifically for more information you cannot give this level of info back. This doesn't help at all.

        We need specifics.. Generally in the Derby area is fknig uselss if we are trying to determine your time in one location for you. Have you or have you not worked in the Derby area for over 2 years? or whatever before that. Trace your timeline and locations back 5 years and post.

        Have you spoken to you payroll company? Who are they?

        If it was my ass on a plate like this I would be posing a lot more detail

          2009-2010 was the yr in question.
          I started with this particular contract in April 2009. therefore was the first yr.
          It is in various location but mainly in the Derby area.
          Never worked through an agency before!

              Listen to NLUK.

              List where you have worked in the last four years. EXACT locations.

              Who are your payroll company ?

              Finally, if this is big enough to 'finish you off', then start getting serious with your answers. No advice you get will be worth a toss without giving details.

                  Speak to your Umbrella Account Manager.

                  They ought to be able to help you, we don't have enough information to have any idea.
