Am I bound to my agencies PSL of payroll companies?!

    Am I bound to my agencies PSL of payroll companies?!

    I'm 3 days in on a 6 month temporary contract and decided last night that I'd like to work through the Ltd Company option as I have done previously. I really liked the company, their customer service, expenses system, speedy email replies etc

    I gave the Umbrella company my agencies details last night and the agency this morning turned them away saying they cannot act on my behalf.

    The formal and final answer from my agency said:
    "as a business we run a very Strict PSL in place regarding payroll companies"

    Please help! Am I bound contractually to the agencies PSL? I understand they will naturally advertise their PSL list but is this final answer?

    I'm loosing the will to live

    That's confusing. Have you got a contract in front of you? Who is it between?

      What do you mean you really liked the company? Which company? If you go LTD it is yours. Explain further as I think this is wrong.

      Dunno if I have just not had enough coffee's this morning but this makes no sense to me. You want to go the LTD route but you have given your agent a brolly???

        This makes no sense. If you want to work within a limited company option then you would set up your own limited company and work through that. Your other comments make it clear that is not what you intend to do. Are you saying that you want to work through an Umbrella company? If so that's completely different from what you've actually said.

        Who are 'they' in that sentence? It reads like 'they' refers to the the agency - which doesn't make any sense so I'm guessing you mean the Umbrella company. Is that right?

        The agency can choose who they are willing to have a contract with and are under no obligation to work with any particular umbrella company.

        Surely this has been sorted out before you started the contract? Do you have a contract in place? I wouldn't start work without one. If you do have a contract then who is it between? Are you using a different umbrella at the moment? Are you PAYE with the agency?

          well...an umbrella company is still (usually) a limited company. Maybe that's what he means. We can but guess.

          Anyway, in answer to the title question but ignoring the confusing post body: not necessarily, the P in PSL just means "preferred". It's just a question of the agency's policy. If you're 3 days into a contract and you walk off site now on the grounds that the agency can't draw up an acceptable contract, you will have quite a lot of bargaining power because the agency will be desperate to get you back on site again.

            If your going to be using an umbrella just go through one theirs as they all do the same job and its only for 6 months (although some of them have a more relaxed attitude regarding un-recieptable expenses)

            If you need the money just go through theirs if youcan afford to be out of work then stick with your principles and expect to be looking for another contract

            It may say "prefered" but most companies that have a PSL generally cannot be a*sed filling in the paperwork to add someone else to it and they are probably getting a kick back from them anyway so the chances of you getting them to use your umbrella are remote, don't waste your time fighting it.

              I don't think it's very professional to commit to a 6 month contract and change your mind about your trading structure just 3 days into it. You should take it as a lesson and keep your head down till the end of the contract/renewal and plan your next move properly. Unless there is a compelling reason (eg, you started work with an unsigned contract ) then don't go messing them about chopping and changing.

              Lots of businesses operate a PSL with their suppliers and there are very good business reasons too. In this case, the "kick back" is probably that they save themselves and ungodly amount of aggro associated dealing with a dozen different umbrella suppliers (some of which may be dodgy/offshore/fly-by-night and leave the agency liable for PAYE/NICs).

                Exactly what i said, why would they be bothered looking into using your umbrella, they have 3 already who they have checked out and are getting good service from so why spend the time and effort involved in assessing 1 umbrella company just to keep 1 contractor happy
