    Hi,

    I am new to this forum.

    I am contracting throught an Agency for a IT firm. 1 month rolling contract.

    I formed a ltd company in September. I will be working for 3 months max. Then my wife and I are emigrating, so the company will be shut down.

    Am I likely to be caught by IR35 if the company starts and ceeses trading in withing 4-5 months?

    I will employ an accountant I think in December to check the accounts.



    Any ideas.

    Nothing to do with how long, it's all to do with how the contractual realtionship between you and the client is structured. Rolling contracts, for example, are a bad thing, since they imply a high degree of mutuality - far better to have a fixed term one with updated schedules of requirements, but that's probably a bit academic in your case!

    You will also need HMRC's approval to close the company, so leaving the country won't stop a tax investigation. That said, the odds are fairly small - go raid the guides on here and the PCG website for detailed advice, and get your contract checked by someone who can render an opinion.
