    24 month rule

    when I sign my next contract I will pass the 24 month at one site rule.

    Do I just stop claiming home to work mileage, or does that mean topping subsistence and other expense claims.

    I thought it was just home to work?

    Unfortunately all travel, accommodation and subsistence stop as soon as you become aware that your contract will breach 24 months.

    Some people get around this by splitting the new contract, so that it runs up to the 24 months, without breaching it, to maximise the expense benefit.

      thanks, what about stopping work....working somewhere else for say a month and then starting agin at old place.

      would that give me a new clean slate?

        If you are luck you're contract will end on say mid December and they wont ask you back till early Jan......hint hint. New contract starting from scratch. I know people who have been here for 6 years who still claim for all.......

          Unfortunately the Revenue see it differently. You have to be away from the same client site for 14.4 months (60% of 2 years) before you can return and start again.

          The Revenue website has all the details.

          As with all expense rules, many individuals flout the rules and they will be OK until the inspectors come calling.

                this is not a grey area.
                It's clearly detailed on IR's website as mentioned earlier and also in both Ann Redstone's IR35 books

                    What about if your working for an umbrella company and then after 2 years you move to your own ltd company. Is the ruling on the person or the company ??? (if you understand what i mean)
