    Working for another client on leave

    Hi
    Can you please advise whether is it legal to avail leave from the current contract and work for another client couple of days?

    As a contractor, if you work through your own ltd co who is your employer?

    As a contractor, if you work through an umbrella company, who is your employer?

    Now think about it in the context of "leave". That should answer your question.

      Thanks for your reply.

      My employer will be my limited company.So it's my company who grant leave.
      However as I have signed the contract through my limited company to provide services to the client and now I need to take break for 5 days from the current client and to work for another client for 5 days .Not sure if I am breaching the contract with current client?
      Please advise.

        Unless your contract states that you are not allowed to engage with any other client during the life of your contract (which would be a rather large ir35 red flag), there is no breach of contract.

        All you need to do is advise your client that you're unavailable for 5 days and give them the dates. Make sure those dates don't affect any major project deliverables as that could be a breach of contract, depending on how it's written.
