Contracting in Germany - 5 Months

    Hi

I have been offered a contract in Germany for a initial 5 months duration.

I intend to travel from UK on Monday morning and return back on Thursday evening.

The current contract flow is as follows

My UK ltd company -> UK Agency->Germany AGency->German Consulting Company->End Client.

I was making sure that the total number of days is not more than 183 days both in present as well as working.

I wanted to make sure this is completely legal as I invoice in Euros via my UK limited company.

After checking with so many websites, all recommended that we can do via my UK limited company for a period of 183 days.

But the below link made me scare.

Can experienced members please comment on the same?

    I'm having a deja vu...

Oh no I'm not. You asked the same back in 2014

I'm sure the information in that thread is somewhat pertinent, particularly the searching advice

You seem to have struggled with contracting in Ireland, Norway and Switzerland in the past as well. Maybe best hang up the passport and stick to UK contracts?

        asking for a friend....

How many days of working in Germany (assuming UK LTD paid in the UK in GBP) before German tax is due?

Is it 1 day? 30 days? Or other?

If it was just meetings in Germany and not actual real work does that change the figure?

The old one i asked was for a 12 month contract. This time it is shorter duration which is less than 183 days.

Doesn't that thread say multiple times the 183 days don't count for LTDs or am I missing something?

Yes at multiple times it states that it starts from almost day 1 so for safety assume its day 1 and get the paperwork sorted asap after you start.....

                    It's simple.

                    1. Local personal tax from day one

                    2. One man companies like typical contractorco, business tax from day one.

                    3. There is no tax harmonisation in EU or practically anywhere inter-country.

                    4. The German Finanzamt (taxman) is the fiercest of them all.

                    5. Don't consider it, you seem way over your head.
