    DOTAS and Umbrella companies stating schemes not DOTAS

    I have yet another question regarding these 85% tax schemes as the take home with no hassle is at times too appealing.

    The scheme i have been referred to states:
    - its outside of scope of tax avoidance so not DOTAS
    - outside of GAAR
    - doisclosed strategy so cant be penalised

    So the question, if i am taking home 85% and no doubt the scheme provider must be talking a percentage. that leaves 5-10% that goes to the tax man how can this not be tax avoidance and oustide DOTAS/GAAR

      Have done a search on the provider to see what's being said about it?

        Yes i have done a search, unable to find any details on the provider. what i want to know is cana scheme provider simply not declare dotas stating it is a non tax avaidance scheme therefore falling under the radar of HMRC. Is this a case where a legal loophole exists?

          You started your exit though haven't you?

          I can imagine you are reluctant to but to get any proper help you are going to have to name the provider I think. It's all just hypothesis until you do. Or is it just a grounding or understanding you are after?

            Real loophole? Not very likely.

            Fraud? Possibly.

            Dummy that is scooping a fat percentage from gullible marks and will do a runner as soon as HMRC get in touch as it's the gullible marks ultimately responsible? Quite likely.

            Anyone fool enough to sign up to one of these schemes has a lot of pain coming in the long run.

              You have to be impressed by the scheme's salesman. The ability to still find gullible fools, after all this time and all the news about crackdowns on tax schemes is really quite impressive...

                    but if the scheme provider is telling me it is out of scope for dotas/GAAR is it not the scheme provider whois accountable as he has given me his expertise knowledge. I am an IT guy therefore dont get all this tax and legal mumbo jumbo.

                    the only concern i have is the scheme is a CBT which i presume is similar to an EBT and so would be in scope for dotas so i just dont get how they can send my return without a dotas reference
