    Approved List

    Hi all

    I'm new to the forum and after some advise.

    I have just started a new contract and the agency are telling me that I can only use one of there umbrella companies from their approved list. Unfortunately my usual umbrella company is not on their list, my question is this.

    Do I have to use one of the approved companies or can I still use my usual one?

    This is very common - you don't have to accept what they are telling you but, then again, they don't have to offer you the contract. Depending on the agency and whether or not they consider your chosen umbrella to be compliant they may let you stay where you are, especially if you have skills that are highly sought after; some e.g. Hays will not consider any umbrella companies other than those on their PSL

      As Lisa said, they can't force you to do this. Check your contract paperwork and make sure it doesnt specify use of an umbrella co. from the list. If it doesn't and they try and force the issue by refusing to pay you, they will be in breach of contract.

      The only circumstances where I could see this being a problem is if the brolly you are using it not a conventional Umrella setup but one which is providing a vehicle for a tax avoidance scheme. In that case they do have grounds for being more concerned about it, as if the scheme is later found to have not worked they may be exposing themselves to liability down the line. They may decide to drop you and suggest you find another agency to work through.

        If you have started the contract, who is the contract between?
