HMRC enquiries for EBT schemes through SANZAR

This thread is for those who have recently received a Discovery Asessement from HMRC for loans made via an EBT in 2008/9 using Sanzar Partnership.

If you have received this notice and are/were part of Sanzar please comment on this thread as we would like to support each other.

It is likely there are going to be ones for other tax years soon. Sanzar Partnership changed to Sanzar Solutions for the 2009/10 tax year, but I am not sure if that changed again as I left in 2009/10.

I would suggest reading the main thread on this issue if you haven't already done so.

Please bare in mind that HMRC (and a certain Miss L J Stopp whom I received the letter from) will be watching..

** UPDATE 21 Dec 2013 - Please PM me if you are interested in joining the Sanzar private forum **

Hi there, count me in, I'm on the original thread from an early post. I've checked with Miss Stopp's office and my appeal has been received OK from Cobham Murphy. They sent a single generic letter, with a big list of names attached to it who are appealing. All F.O.C. so far, but I'm wondering when the fees will kick in...

I was in 08/09 for a bit and 09/10 for longer, before leaving. I would be interested in checking your scheme ref numbers for both these years, as in theory Sanzar may have offered multiple schemes, but unlikely. Might be better to PM these?

I have an open COP8 enquiry for 09/10 as well as the 08/09 letter, so I've got that to look forward to as well. Anybody else with an open 09/10 enquiry, bit off the 08/09 topic, but curious?

Oh BTW, Garraway were definitely previously Sanzar as I emailed somebody at Sanzar once and got a reply from the same person but with a garrawayconsultants email address. Methinks she slipped up there !

Maybe this is a warning to those currently with garraways - don't expect them to hang around for more than a few years, or support any legal challenge. They will disappear whenever they fancy it. The directors are the same crowd I expect, just closing one company/trust down and starting up a new one when the heat gets too much.

          Sanzar

Hi all, im in the same boat but a bit further through the process. I have received the 08/09 letter and responded, have now got a request through specialist investigations for information on 07/08. I did have a message from Sanzar in 08 stating that they would pay any tax owed from an investigation but cant find Sanzar to claim this!!

I'm in for 08/09. Tried Garraway with no success other than a pointer to Contractors Helpdesk. I engaged Cobham Murphy too and got my appeal letter in.

I've tried directly emailing some of the Sanzar contacts using other email addresses I have, but no response (and no surprise!). I've found various emails from 08/09 with lots of info, so I'm keeping that to hand. I declared all of my loan payments on the 08/09 return so question the legality of the discovery assessment. I also completed and filed form AAG 1 to disclose my participation in the sceme.

I have a trusted contact in IoM who is providing some advice and also seeing if he can get hold of Sanzar representatives. Will keep all informed of progress.

Old Kent Road - I owe you a PM which I will try and send tonight.

I am thinking that we might like to check the case law so far against the scheme we were in and also the progress of the other schemes (for which there so far seem to be a few more people who can pool resources and brain power).

I've set up the thread, but am no tax expert by any stretch, and want to make sure that we are doing everything we can to help ourselves.

My accountant has finally recommended a tax specialist to me (after asking me three times if I was willing to settle!!) and I have another recommendation. Does anyone else have any contacts with those who have more specialist knowledge.

Those who have used Cobham Murphy, do you know how far they are willing to help and at what cost? I asked about costs and was told it was FOC, but I suspect that was just for the initial help with the appeal letter which we got free via this forum anyway.

                Sorry, lots of questions!

I have a contract for my time with Sanzar Solutions in 2009/10, but do not have anything like that for my time with Sanzar Partnership in 2008/9. Does anyone have any contract/paperwork relating to that year (or previous years) which would give me/us a better understanding of how the scheme ran and therefore enable us to compare to other schemes?

What sort of sums are we talking about from HMRC? settlement may be ok for small sums but for larger sums thsi could break people...

Mine was a month with Sanzar Solutions and then two months with Sanzar Partnerships, so not great sums, but principle all the same..

I have been with sanzar since 08/09 to 10/11
They are now Darwin & garraway
I have had letters stating HMRC believe they are not loans
I have been referred to contractor help desk who have very little info from ex sanzar, it looks like sanzar have done one appointed this help desk and Cobham to buy time
Cobham won't talk to us and the help desk have no knowledge so when he funds run out where does tis leave us with Cobham as its clear they represent sanzar as they are paying them.

Does anyone have any suggestions as I don't have the funds to pay for 3 years.

                    Please help

                    Thanks in advance
