I have stated before a few posts back that I have paid into the group with Elysium to close this problem out. No amount of AI searching or wishful thinking is going to resolve the issue. I would rather pay into the cause than sit on the bylines waiting for others to resolve it. That said, Elysium need to be proactive and go at west 28th, if they don't, then I will need to reconsider my position and look for an alternative solution.

The AI is extremely useful, however, it depends on what documentation you have and what commentary it contains.

People are forgetting the nuances … we’re not all in the same boat.

Do a SAR, get all the paperwork they have on you, run it through AI and you’ll have a great starter for 10 … it calls out the good and the bad.

Same, agreed and i thought that’s what they are doing?

But if you’re liability is small, or you can’t get hold of the fees, or simply refuse to pay anymore £ towards this, or are sceptical of anyone else trying to help, i understand why people aren’t doing the same.

They definitely should understand any nuances of their situation - but I don’t think they should be too concerned

I spoke to my solicitor about this, and his view was that, if this does end up in court, it may actually work in the contractors favour for the matter to be fully examined rather than quietly settled.

His reasoning was that there appear to be significant inconsistencies in the paperwork and the chain of assignment/ownership of the loan book, including discrepancies in the documentation that would need to be explained under scrutiny. In that context, a court would likely require clear evidence of proper assignment and regulatory compliance.

If they are unable to properly evidence how the loan book was transferred and on what legal basis they are now asserting enforcement rights, then that could become a serious issue for them in proceedings.

Has anyone not had their subject access request to Trethowans and/or West 28 fulfilled within the required month?

It's been called out before and more than once ... get your SAR submitted ASAP.

It generates work for the enemy and the information they hold on you can be illuminating as well as very useful.

Don't sit back hoping others are going to do the heavy lifting on your behalf.

I have a SAR template I can share if you PM me.

HMRC has posted advice on this.

                  we have set out:
                  • some guidance for individuals affected by this, including actions you can take to protect yourself
                  • other organisations you may wish to contact
Not a lot but it’s better than nothing.

As I pointed out to Simon earlier that's been around in almost the same format since 9th Feb 2022.

In fact the last changes was adding "This is a rare occurrence and" removing the word recent.

And, as most here will know, the FCA Register search for Kenneth Charles Arnold comes up with this individual's regulatory approval is no longer required as he is no longer carrying out a role that requires regulatory approval.

And that neither West 28 Ltd, Limelight Solutions Ltd or Coldbath Solutions Ltd are FCA regulated.
