Last time (2023) I got a local solicitor to send them a letter to Workcap(£350) and never heard anything back until the new entity reared its ugly head. They knew they weren’t getting anywhere and that gives me heart in this one.Originally posted by TW2001 View Post

I’ve seen the recent request for confidentiality, so I won’t go into specifics, but I share the discomfort others have mentioned. I don’t understand why open discussion between affected individuals in the same group is being discouraged.
I’m also struggling with the volume of paperwork being circulated simply to commit further potentially uncapped funds, particularly without clear visibility on participation levels or alternatives outside the group structure.
For now, I’m taking independent advice before deciding anything further.
couple of things though that don’t sit right
Felicitas assigned the loan on 24th April so why was West 28th chasing me in 2023 if that was the case?
They have given a list of solicitors to use… To coin a phrase I believe they’re all ‘pissing in the same pot’
I also believe if this carries on then we should as a group find legal representation away from the ones mentioned

12 years since I last received a payment.....
I'm going to stick with Elysium for the time being. They have a vast amount of legal knowledge about the case and although I'm tired of making payments to companies to sort this problem, when it does go to court I believe they have a war chest of technical jargon ready to challenge any claim.Leave a comment:

The limitation clock starts from the date of the breach (when you first stopped paying or when the loan was due), not the date of their 'final offer'. but as Wtaf says below the six years is from the last payment you received from them or repaid them.

On the statue barred issue, the first communication i can find relating to recall/settlement offer was from felicitas on 30th july 2020. But this does state Final Offer.
Which is nearly 6 years.
I have the original scheme brochures, i have emails clearly explaining the loan as salary, i have the successful dotas registration email. Been lurking on here a long time but i think this is crunch time, everyone’s last chance to get more from us.
But really not sure what to do

I'm viewing this as a psycological game by West 28th Street and they are likely banking on the "path of least resistance." By appearing official and threatening, they hope people will pay to avoid the stress. They have borrowed the air of authority by having Trethowans involved, but other solicitors have been involved before now and that made no difference. It's easier to bulk send massive letters in the hope that even a small percentage would pay up and make it all worthwhile.
I've been through this for so long that i'm emotionally detached from the situation and i'm so thankful for this group in pointing out the obvious, that they are indeed statue barred now (unless you have made any payments or acknowledgements to any so called loans).

Their fixed fees haves magically trippled. They have massively over complicated things. For confidentiality, I won't repeat exactly how.
We are better off coming together and finding another firm who keep it simple and charge a couple of hundred quid. All we need is them to reply to them on our behalf every time some silly demand is madeLeave a comment:
