    Unfortunately you simply pay the tax that you were trying to avoid, these were not loans it was simply a method to avoid paying the income tax (we all know thats the truth) - this is what i did for the years 2008 till 2014, painful i know but thats life.

    Make sure that the HMRC has all the facts and are charging you the correct amount so worth checking with tax guru then ask for repayment of 5-7yrs thats what i did.

    Sorry for being straight but it's easier to deal with this way.

    PLZ dont be naive, Winchesters will have provided the HMRC all the info they have on you and all the others caught up in this mess - it would be part of the agreeent between HMRC and Winchester.

    What surprised me is that HMRC in one of the documents they sent not only had Winchesters name as company perceived to have paid me the "loans" but also the exact money paid to me. How would they have obtained that?

    Personally I'd contact a specialist tax advisor and at least pay them to look at your affairs and confirm whether what HMRC are claiming is correct. They can also deal with HMRC on your behalf, but of course they'll charge more for that.

    Assuming you & HMRC come to an agreement on how much you actually owe them, they should be happy to agree a Time To Pay schedule where you pay a certain amount back per month. They take your income and outgoings into account and propose payments you can realistically afford.

    I am aware these are 2 different issues. With W28 heard nothing since Jan 2023 1 letter only didn't respond!
    It's how to handle HMRC...SA is my current concern as only have to 5th May! to respond!

    There's two separate issues here I'm afraid. HMRC now want the tax you avoided by working through a tax avoidance scheme between February 2013 and March 2014. One way or another you'll have to settle with HMRC but that doesn't have anything to do with the loans you have outstanding. Many people here have faced this situation, so you aren't on your own.
