    Should I be worried that my agency has started sending me payslips?

    Hi,

    I've been working for this agency (different contracts) for a year or so. I work outside of IR35 and through my own limited company but recently they've started sending me extra documents with their remittance advice:

    The PDF is prefixed with PAYSLIP_ and I've blacked out the sensitive parts. Should I be worried? in particular I'm concerned about how this might make me look in the eyes of HMRC. It's basically describing me as an employee through a limited company which I would refute. Any one else seeing this sort of thing?

    I get a remittance advice as I'm sure many do so not a problem with that. The agancy using the wrong title for the doc is irrelevant so don't worry about that.

    You could of course ring them and ask them to explain.

      Plenty of agencies do these. As long as it’s day rate + VAT with no deductions then carry on.

        The terms WORKER NO and PAY DATE in this image ring alarm bells with me - surely the poster is a service provider not a "WORKER" - the dictionary definition being "an employee, especially one who does manual or non-executive work"

        I'd be telling them to send a different remittance advice or moving on

          It’s a remittance advice. I’d hope that a remittance advice has a pay date on it - that’s the date the payment is made for the invoice. Also, by it’s very title of “remittance advice” it is a payment from a customer to a supplier.

          But since it is a note to say a payment has been made against an invoice, then it’s of little value compared to the invoice itself or the money in the bank account.

            An agents incompetence in their wording has no bearing on your IR35 status... That is unless it extends to your contract but you had that checked didn't you?

            As I said before, why don't your ring them and educate them?

              I've been getting these each week (from them - 99% same agency) for the past 18 months. Not worried.
              I've had the contract checked by QDOS and they have raised a few issues, which the agency addressed.
