    Can i ask for notice period clause in my contract?

    Hi,

    I am totally new to contracting, got a contract from my agency in which they have mentioned that they may give a 28 days notice for my service termination but there is no clause in the contract which states that i can also give them a notice for leaving.

    Its a long contract so I wanted to make sure that i have that right too.

    Is it okay if I ask them to add this clause to my agreement?

    Please reply, i need this answer urgently. Thanks a ton in advance!

    What you urgently need to do is:

    Try searching
    Learn a little netiquette (hint: "urgent" is rude)

      You can ask for whatever you like in the contract. It's part of the negotiation. Doesn't mean they'll say yes though of course!

        Double check if it affects your IR35 status - others here will be able to confirm.

          No it is not okay to ask for this in your contract.

          Do I assume you are not getting it checked by QDOS and the like first either?

            You not having a notice period isn't actually a problem for IR35 either way. However them having a 28 day notice period means they may have to pay you when there's no work to be done, which is bad for IR35.

            However, as has been said - get it reviewed by someone like Bauer and Cotterill and then get reading, you have no idea how much you don't know.

              I have a 3 month notice period in my contract. My accountants (It contractor specialists) said the contract was ok

                    Is there any indication of mutality of obligation in the contract?

                    If none exists then no notice period is required, and any notice period can be invalidated anyway.

                    i.e the supplier may refuse to perform services to the client, and the client may refuse to supply work to the supplier.
