Bank charges caused by agency

Vague subject, I know but...

I've been charged almost £200 bank charged and my mortgage payment has failed because my agency "lost" my invoice and still haven't paid it. Is there any way I can recover these personal losses from the agency? Or is that too far out?

As long as they still paid you within your contractual payment timescales, there is nothing you can do. If they didn't you have recourse under contract law, but it's a nasty murky area if you're only talking about a small amount like £200.

Have you got proof that you sent it in the first place?

And what does your contract say about payment terms? Sometimes people I know moan because an agency hasn't paid in say, a week, like they usually do when in fact the payment terms in their contract is 30 days.

Well if there's no mention of a particular invoice cycle, you don't really have any case unless they are unreasonably slow. How late were they? You shouldn't really rely on invoices being paid when it comes to your personal cash flow, things happen, bank holidays, postal strikes, delays are almost inevitable somewhere along the line - always keep a bit of a float.

1. "My Invoice". Wrong - the company (of which you are an officer) raised the invoice, not "you".

2. If your employer failed to pay YOU in a timely manner then take it up with your employer. If you have forgotten who your employer is, see point 1.

3. If the agency is in breach of the contract it has with its supplier then that is an entirely seperate matter.

cant you keep a buffer of say £1000 as a min in your bus account. I have several £k in my account just siting there to be paid for corp tax but it also acts as buffer in case agency are delayed in paying me.

If it happens again send them an email to them stating your problems and if they can share your costs. If not then tell them you seek to request the end client to change the agency to another - should keep them on their heels

You sound like one of those 'rate tart' types who must have every penny earning interest so uses a JIT system to scoop every last penny into a high rate deposit account. Problem is things go tits up if you have a late payment or you yourself forget something. It's an avoidable accident waiting to happen and it happened. Blame only yourself and learn from it. Keep your current account well stocked with ££ in future.
