Unable to give notice?

My agency are trying to get me to sign a contract where my client is able to give 1 weeks notice but I cannot give notice and must fulfill the whole 6 month contract.

I want a 1 month notice period from me, but they are refusing to do this. i have actually been working the contract for a couple of weeks. If I just leave now, would I still get paid for the few weeks I've paid?

You could always phone up and say you've got a bad back and you're not sure when you'll be back to work!

The first part you talk about "sign a contract" - the second part you talk about "working the contract". How many contracts are there here?

Would it not have been better to get the terms agreed before you started?

Personally, having started I would complete the gig and learn my lesson for next time. I dont like burning bridges.

Employees have to have notice periods. You don't. Therefore you are probably not in an employee relationship with your client. It's only a little thing, but every bit helps...

If you are forceful with the agent they will change the terms. Has happened to me many times. I have heard no notice is better from an IR35 perspective but not a major factor. I would rather a get out clause in case the place is awful as this has happened once and there is more to life than spending 40 hours a week somewhere you hate!

I have always figured that if I really really wanted to leave, I could persuade the client that they really don't want me to stay.
