    taken agent to court?

    Hi

    Has anyone ever had to take an agency to court for breach of contract to recover overdue payments and to seek to backdate a move to the end client (so outstanding invoices, can be submitted to end client)? Lets assume the agency had agreed to let the contractor go direct to the end client… but not backdated the outstanding invoices.

    Any ideas on success rate for this type of action?
    How long does it take to get to court?
    Roughly how much did it cost?

    I would expect that you've got no chance of the court changing the terms of your contract (i.e. backdating the change). All you can do is sue the agent for the outstanding invoices.
