    subsistence claims and mileage

    Hi People,

Hope someone can help because i have had three different answers to the same question surrounding subsistence. Please read the statement below. I have added my thoughts around the subject.

    Hi Lisa,

Now Its my understanding that subsistence is simply a food allowance during your working day.

If what your saying is.... 'you can not claim subsistence if you are travelling to the same work place each day' iam very confused.

This would mean only the like of plumbers and electricians would be able to claim subsistence as they may travel to 3 or 4 different jobs per day.

So what your saying is that millions of contractors that DO travel to their 3 month assignment for example cant claim sub because they travel to that place each day in that 3 month period??????

its under 24 months so its a temp place of work and they can claim sub and mileage as far as i am aware.

Please can someone correct me if i am wrong

    thanks

that's pretty much how I understand it. TBH the subsitance is so small (normally < £5) I don't bother claiming it even when working at a different site \ travelling.

You can claim £5 subsistence if you are working away from home overnight, this doesn't need a receipt and is for indicental expenses. Unfortunately you can't claim this amount if you are going to work from home each day.

I understand the incidental aspect, but i did ot understand what you meant when you stated that contractors could not claim subsistence if they were travelling to the same place of work each day??

if they are at a temp place of work (under 24month rule) surely that statement is wrong??

        please can you clarify this?

Plus you can also claim actual Breakfast and Evening Meal (Receipts needed) when staying overnight in addition to the £5.

It's quite simple really. If you are based at a client's office, and you travel there every day, then you CANNOT claim subsistence, UNLESS you stay away from home overnight.

The 24 month rule ONLY applies to travel expenses.

Unless you are with a brolly in which case you can claim for whatever you like without receipts as you have dispensation! Plus HMRC have given them letters to prove this!!!

I think we need a "Sarcasm" smile, for those who don't understand what a dispensation is / how an umbrella company works / what expenses are!
