    Do clerical workers count when getting a business insurance?

    Hello,

    My wife is mainly doing clerical work for the company, but when I asked my accountant about her status for other subjects (like mandatory pension enrolment), she told me that she didn't count as an employee so it was not required for me to register.

    The doubt now is regarding business insurance (professional indemnity and public liability + Employers liability). Companies ask for the number of people to be insured in a few different ways:
    • Number of workers: What is the total number of employees in your business (including Directors, labour only subcontractors and temporary employees)?
    • Number of Employees: Please choose the number of people working for the business including any Directors, Principals or Partners. Please note that the maximum number of people covered under this policy is 5 (including Directors)
    • How many people need cover?


    Do you know if I should enter 1 (mainly to insure me when I go to a client) or 2 (if she counts as well for this purpose)?

      I wouldn't think so, ie, she's neither director nor secretary, but she's got shares on the company and helps with the admin work...

          Does she really need PI PL or EL? What is she doing that might need you to claim on these?

            EL isn't so much what she is doing that might warrant a claim, as an employment protection in the workplace?

              @OP

              PL and PI are discretionary insurances. EL is compulsory. I looked into the position of family members and EL, and my conclusions are here:

              Also there is no automatic family exception for Pensions auto enrolment AFAIR. Issue will be around salary and whether she is an officer or not.

                Another exemption applies here:
                companies employing only their owner where that employee also owns 50% or more of the issued share capital in the company
                This would exempt a situation where
                (i) a controlling director (50% shares or more of shares) is the only employee; and
                (ii) where two people work for the company and have 50% of the shares each.
                I noticed in another link that they mention one would need 51% of the shares, not 50%. Do you know why that might be? or which figure is the correct one?

                If you are a limited company consisting only of yourself, and manual and clerical staff, where you own more than 51% of the business, then employers liability insurance is not required.
                If you are a limited company consisting only of yourself, and manual and clerical staff, but own less than 51% of the business then employers liability insurance is required.
                If you are a limited company with more than one person then employers liability insurance is always required.

                  Well your accountant should be helping you with this but failing that there is google.

                  If you are struggling with all this I'd recommend you give QDOS a ring who specialise in this type of thing. They will walk you thought it all.

                    Thanks for the link, I didn't know what to search for.

                    I asked SJD two or even three times at the time to try and get further details to understand that, and they mainly kept coming back saying that I needed not to worry, although not much explanations about why not. I've not checked QDoS Accountancy services to see how they compare to SJD (which were kind of expensive last time I checked)
