HMRC Enquiry for schemes through Darwin.

    Hi Friends,

I received a letter from HMRC Revenue & Custom on 15th Oct (Saturday) for an oustanding tax on the earning I had through umberlla company "DarwinPay Partnership" in 2010-2011.

I have contactecd Darwin and waiting for the advise but would appreciate if you anyone has any peice of advise to offer. The tax due is 7500 GBP and the deadline given is 14th Nov 2013. I am currently outside UK and it makes more difficult for me to apply for appeal.

    Questions:
    1. Is there any way I can reduce this tax if I can't get rid of complete amount?
    2. Is there any way I can pay this in monthly installaments rather a full payment as it's a quite big amount?
    3. How should I file an appeal when I am outside UK and what information I need to put in the appeal?

    Thanks for help in advance.

    Cheers,
    Sanjay Kumar

I suggest you read the stickies at the top and look in one of the other scheme threads. I think you'll find all the answers there as the procedures are pretty generic.

There is a template letter for an HMRC appeal in one of them somewhere - use that and keep it short and simple.

      Hi Sanjay,

agree with convict. Here's a link to an example appeal letter template kindly provided by Michael Perry:

You should seriously consider sending your appeal by registered post to the address in your assessment letter.

      cheers

HMRC Tax due letter for 2010-2011 year with Darwin Pay

        Hello

Today I have received a letter form HRMC saying about tax due amount to be paid for 2010 - 2011 when I was with Darwin Pay

As I was looking through the forum, there is big community who has got these enquiries which feels me light.

I have raised this with Darwin today, waiting for their advice

I do have couple of questions, does this Darwin Pay operated on EBT or any other scheme for the year 2010 - 2011

Going through this forum, i am almost decided to go for appeal? but what my concerns is that after appeal what is the next steps? has anyone gone through the next steps like receiving reply for the appeal and what next??

        Thanks all for this forum

        YVS

People going through solicitor or sending standard letter

Hi I called darwin today and it seems darwin pay partnership has been liquidated and they can now carry on Scott free with new schemes under the darwin name!

I was redirected to the contractor help desk, which seems a sham to me.

My bill is from 2010-2011 and quite hefty.

Any advice on what to do next appreciated.

Read the main thread and once you've done that send out an appeal letter.

HMRC Enquiry for schemes through Darwin.

I have also received a Notice of Assessment for The Darwinpay Partnership for 2010-2011 under the discovery provisions of Section 29 Taxes Management Act 1970.

I was too pointed towards Contractor Helpdesk who has emailed me info.

Are there many others in the same boat who used Darwin? This thread doesn't seem to have many replies.

That's because Darwinpay is/was a young scheme. This thread was originally started in the Sanzar thread as a single post before moved it out to here.

Have a read of the Sanzar thread to guess why that might be...

                  Appeal in

I also got the letter from HMRC dated the 31st October for my involvement with Darwin in the 2010/11 year, and I appealed. My self assessment online now says the amount is under appeal. I too haven't seen many people posting about Darwin, even in the other threads...

                    Darwin Pay

I had a letter from HMRC back in November 2012 advising of investigation under Code of Practice 8 (Re Tax Avoidance Scheme with Darwin Partnership) - related to my 2010/11 tax return.

I did not contact the HMRC, and contacted Darwin and they referred me to Contractor Help Desk and they forwarded my letter to Cobham Murphy.

No further contacts from HMRC since. No request for any payments either.
