    Proposal to strike off

    Hi. Took a look on Companies House about a potential supplier for a contract we've tendered, and their status is 'Active - Proposal To Strike Off'. They were incorporated 18 moths ago, but have never filed any accounts, and are showing as overdue on their first set by 6 months. Don't touch with a bargepole, or is this a common occurance?

    It means they have applied to Companies House to have their Ltd closed down. Definitely should be avoided.

        It could also mean that because they have not filed accounts that Companies House is proposing to strike them off

          Ask Threaded, I believe he has some experience in the arena of "proposals to strike off".
          His heart is in the right place - shame we can't say the same about his brain...

            Hi

            I found this thread when I Googled the term "Active - Proposal to Strike off ", as this is now the status of a company that owes me a lot of money. The owner of the company is my former employer, who is doing everything in his power to steal unpaid salary and a tribunal award from me. It also shows his accounts as overdue.

            Do you think he could be doing this deliberately in a further attempt to steal my money? The tribunal award has been lodged at the county court, so I am an official creditor of the company, but nothing is below this guy when it comes to hanging on to other people’s money.

              Get Thomas Higgins onto him. It's worth giving TH a call to find out what you need to do next.

                Thanks, but as long as civil justice costs money, he's got away with it. As a direct result of his actions I am now unemployed and in debt, and cannot afford court and/or debt collectors fees. A fact I'm sure he was banking on when he refused to give me my money.

                  Rubbish - take a look at the site, action starts at £2 or take them to court yourself - ask AtW for advice 'cos he's done it (without spending a huge amount).

                    Not at all.

                    Believe me, there is nothing I would like more than to get my money and cause my former employer as much hardship as is humanly possible, but the fact is that civil justice does cost money, and it's money I don't have.

                    From the site:

                    Costs to issue court action

                    Costs + Vat 165.00
                    Court Fees 390.00
                    Total + Vat On Costs 555.00

                    I have explored many avenues in the past, and every single one cost me a few hundred pound at a time, and it was nothing he couldn't effortlessly side step.

                    He changed the registered address of the company to the same address as several of his other Ltd companies, making balifs a waste of time. He created a new Ltd company just before the tribunal, to ensure that the one that owed me money has no income. And he's now not submitting accounts to get the company struck off. All the time the system is allowing him to do this whilst placing the onus on me to PAY every step of the way to pursue him.

                    Can you honesty say that if I beg, borrow and steal a few hundred pound to take this further that I wont just be throwing good money after bad?
