    Stock Options - Make me Inside IR35

    In the contract I have receieved there is a clause offerring me stock options.

    I assume this is likely to make me liable to being inside IR35

    Apart from that, I think the contract looks like it would avoid IR35

    Any thoughts?

    Are they or will they be worth anything? If not, remove the clause. If they are, do the maths and work out which one is more in your interest; keeping the options and paying the tax, or binning the options.

    If in doubt, speak to your accountant because we're all buffoons here...

      Who are they offering the options to - you personally or the company?

      You might be able to argue that what they are actually offering is an equity stake in the company based on performance by your company.

      I'd ask someone like Bauer & Cotterell or Qdos to review the contract and see what they say.
