    Contract renewal scruple #143

    X month contract with client A via agency B due for renewal with ltd company C

    client A realises agency B isn't on approved suppliers list
    client A asks ltd company C to renew with agency D
    agency B and agency D do some kind of deal behind the scenes

    ltd company presented with completely new contract with agency D, different Ts&Cs, payments terms which needs to be assessed

    Any views/advice if this is good / bad

      so long as you are happy with the terms, how could there be a problem?

      Happened to me once, and I only had 1 month left on contract.

      Just be glad they came to a deal, you could have been terminated.

        Similar scenario to when a Tier 1 PSL approved agency can't fulfil a gig so they sub the work out to another agency.

            What other options do you have?

            Check if your client has agreed fixed margins with the agency. If not ask for a rate uplift because agency D has had shed loads of money handed to them on a plate for no effort so shouldn't expect the same margins as the old one.

              Yes, I suspect that the new agency will be more than happy to just hand over half of their margin simply because some expendable contractor upstart merely says so.

                  Tell them you expect the same rate, payment terms and the T&C's as the original contract with the original agency.

                  However, if you want to hold out for all of this and they are not in agreement with your request, you need to assess whether you'd refuse the extension and walk.
