    Contract signed, waiting for SC clearance. Search to continue..?

    My friend signed 3 weeks post dated contract and going through SC process. Should he continue to waste his energy on job search or enjoy his free time till contract start date hoping clearance will be completed positively within that 3 weeks ..??

    If he find another tempting offer while waiting for SC, is it OK to ignore signed contract and join what he got in his hand..? what are the legal implications..?

    It depends on the terms of the contract. What does it say about termination?
    EDIT: You cannot just 'ignore' a legal contract. If you're going to use dumb language you should expect abuse from the NLxUK

        no idea. What does the contract say? Or is it just a start date in the future?
        Has the SC clearance process started? It costs the end client c. £8k (it did in 2012) for clearance, hence why most clients tend to start the contracts anyway as they'd be peeved if they lost the contractor. If it was offered to me I'd want a retainer of around 30% my day rate to keep me off the market, but would then still be looking as "who knows".

          You'd be best to get your friend to ask on here, that way you won't need to go back to him all the time with our updates.

          There is nothing to stop your friend from looking for work at any time.
          He should be aware that if the agent or end client hear that he is looking for work after he has signed a contract with them, then it will not reflect well on him.
          I'm sure that with all your experience, you've already advised him of that.

          If he is still sending out 1,000 emails a day and not following any of them up, then the situation may be different in that he will ignore any advice given on here

              He shouldn't waste energy as that would be fruitless, but energy spent may not be a waste...

              The contract may fall through at any minute so it's worth being down the path of finding something else.

              If a new contract is taken then there are probably no implications in walking away from the old one. Tell the client you won't be starting. If they are difficult, hand in notice and ask them if the still really want you to start. If they say yes, offer a sub. If they refuse sub, tell them you are unavailable for work for the notice period as you're on leave. If they threaten to sue, tell them you've converted to a religion where you can't wear clothes or wash, but are happy to turn up if they are supportive of your religious convictions. There's always a way out of a contract.

              However, social club clearance can come through quite quickly, so make sure 'your friend' starts saving your change for the parking machine in case you get the green light.

                If his friend comes on here and sees all Darren's other posts he certainly won't be asking him for advice ever again.

                  And just be helpful, it is possible in some cases to get on site when SC hasn't been granted. There maybe systems or tasks he could carry out under supervision where he doesn't have access to sensitive materials. I wouldn't be staking anything on thst though. It's only a possibility in certain situations.

                    And to cover the abuse angle.. Ignore a contract. Jesus. You never fail to disappoint do you. Would you be happy if an agent ignores a contract and decides not to pay you or drops you at the last minute for someone thst has a clue about how to be a contractor? I don't think so.
