    Use of Rental Flat for Coaching Business

    Hi there –

    I was wondering if the following is possible:

    I would like to offer a personal, home-feel type of experience as a personal coach. So I thought it would be best to rent a studio flat and expand my coaching business from there.

    Would this need to be declared in my tenancy agreement? Visits would be minimum to 2-3 per day. I also would use the flat as my base in Central London vs travelling back home during weekdays.

    Any thoughts re: business rates or these won't be applicable? Any laws I should look at?

    If you are renting a place, you would need to be very clear when you are taking the tenancy that it will be a place of business, as most rentals are on a none commercial basis, and will probably stipulate that the property can not be used for business purposes. Not sure about business rates, you would need to contact the local council about this. You would need public liability insurance as a minimum also.

      ^ this. Most shorthold tenancy agreements will have clauses around no business being done at the property and this particularly covers clients visiting it. The last thing you need when trying to run a business is for you to be in breach of your contract and getting turfed out.

      You'll be invalidating the landlords insurances as well so need to be very careful.

          Most leasehold flats, whether the leaseholder is also the freeholder or not, have leases that state you cannot have business clients visiting you in them. If the owner then rents the flat out this is stipulated in the rental contract, and this is why this clause is fair in rental contracts.

          The clause is to stop people using them as brothels but also to stop nuisance being caused to other occupants who live in the building by multiple visitors.

          Therefore I would strongly doubt you would be able to do this legally.

          In regards to business rates - if you are annoying the other occupants in the building by having multiple visitors - they can also contact environmental health as well as the freeholder to get you booted out. So you wouldn't get as far as sorting out business rates.

          There are studios which are more artist living spaces where what you want to do would be allowed but you would have to rent them for the longer term. linky
