    Aml pbt 2011/12 hmrc

    Hello

    I got the following from AML today. Not had the HMRC letter yet but anyone else have this and what does this mean?

    Dear xxxxx,



    HMRC have recently made us aware that they will be following up their check into your 2011/12 self-assessment tax return with a formal assessment. They will issue a letter to you, to this effect, shortly. Upon receipt of this assessment, please forward it to [email protected] immediately so that we can properly assist you. For your information, we have attached an example of the assessment calculation which is likely to accompany the letter that you will receive.



    We have brought this to your attention not only as a matter of fact, but also to highlight the level of co-operation that exists between AML and HMRC in these matters; we are, and always have been supremely confident in the robustness and compliance of our planning and will provide HMRC with the information they need, in order to give them similar satisfaction.



    In addition to forewarning us of this assessment, HMRC have also granted us the ability to appeal on a collective, as opposed to an individual, basis, which will make appealing on your behalf a much smoother and quicker process.



    Any appeal must be lodged within 30 days of the date of your letter, highlighting the need for you to send a copy to us immediately upon receipt. Our ability to appeal on your behalf is contingent upon receipt of your letter, and also upon AML being your authorised agent in respect of your 2011/12 tax affairs; as you have provided us with a copy of the letter to HMRC, granting AML this authorisation, you need take no further action once you have sent a copy of your assessment.



    Once we have everything we need from you we will file the appeal on your behalf; within 24 hours of filing, we will notify you by email so that you can be satisfied that no further action is required on your part. We will contact you as and when anything further is required, and send general updates for comfort, in the absence of any further requirements or feedback from HMRC.



    AML stand firmly behind our planning and will ensure it is defended from challenge by HMRC.

    Had the same email. This is basically HMRC gearing up to be ready to start issuing APNs to non-dotas schemes, once the APN legislation is expanded. Just my opinion, but it is pretty clear to me and what I expected. The appeal just means the tax will be stood over and interest will accrue, until either the matter is settled in court, or you receive an APN. Expect the latter and start planning for it now!

      p60 and p11d

      Hi,

      I got this letter also.

      Has anyone found that AML did not submit P11D and P60's for them in 2011/12? I asked them for mine and they told me I wasn't employed by AML then even though I was employed by them until Nov 2012. They had issued me a letter stating I repaid some of my loans on the 15-04-11 which would have appeared on the P11D if they had produced one for 2011/12.

      Any advice welcome.

        Not sure I'd be divulging this information, considering HMRC read this. I'd join the group for this (assuming there is one).

          I think you will find you were not employed by them, I believe those who were on PBT were self-employed.

            Non-Dotas is a tad more difficult, because that would, in essence, catch all tax in dispute no matter the arrangements used.

                Legal counsel is sought and advice taken whether to register DoTAS of not (this is what I was informed of way back then)

                  should I let HMRC know I moved from UK to France

                  Hi

                  Thanks for your responses to my earlier questions.

                  I have yet to update HMRC that I have moved to France in 2013. Are they still likely to chase me for the outstanding money (20k) if AML loose the case? Are they likely to inform the French authorities and can the French enforce this on HMRC's behalf? No APN has been issued yet.
