HMRC enquiries for EBT schemes through SANZAR

    Also in Sanzar during those years. Received the letter and have now appealed. The numbers they have make no sense to me and I don't recognise any of them.

    Expecting them to come back asking for more information. Please can someone point to advice on how to respond to this? I'd be keen to get proper advice.

    I was also wondering, is there a difference whether I was on self-assessment those years vs not being on self-assessment. I don't recall that I was required to do self-assessment.

      Another joiner to the Sanzar fold

      I also received my 08/09 discovery letter on Friday although I had been pre-warned it was coming by Cobham Murphy (CM) via the contractor helpdesk - all my communication from HMRC are going to CM because they asked me to fill out out a 64-8 form to appoint them as my agents to act in response to the 10/11 letter I received.
      If you have your own accountant dont fill out a 64-8 as they advised as this means your accountant will no longer be able to deal with you day to day dealings with HMRC which is a pain. Contractor Helpdesk/CM should advise you to complete a comp1 form for each specific year you want CM to represent you which doesn't then proclude your normal advisor.

      I have the double whammy that my first 4 months of the 08/09 tax year was with Edge/Norla and the remainder of the year with Sanzar - anyone else got it split across two?

      Happy to be involved in pooling resources re Sanazar.

        The Sanzar Partnership Loan Agreement

        Can anyone assist me i'm looking to get a copy of the loan agreement that The Sanzar Partnership used during 2008/2009.

        Also received HMRC letter for 2008/2009 with an estimate of my tax liability. Questioned how this was calculated I was told that HMRC took my taxable income I submitted in the tax return and that they choose a multiple of 7 and that's how they worked out my tax liability. (this seems quite strange)

          Nearly correct!

          The HMRC form Comp01 should be completed for the particular year (for example 2010/11 for the latest tax enquiries or 2008/09 for the recent income tax assessments) and this will cover other tax years if the investigation is extended to other periods.

          Some of my clients have three or even four ongoing HMRC enquiries on different schemes. All permutations are possible!

            Without causing offence can I suggest that we don't request or supply scheme documentation via forums or via PM as there is nothing to stop HMRC posing as scheme users and getting early sight of these docs. These kind of docs should be officially shared via Cobham Murphy or our appointed tax advisers.

                You should seek proper advice from a tax specialist, I wouldn't continue to go it alone if that's what you've done. The tax specialist will advice on how to respond to HMRC and should respond on your behalf, including the self assessment questions. A large number of Sanzar users are dealing with HMRC via Contractor Helpdesk/Cobham Murphy, so Cobham Murphy will deal with and advise next steps re. HMRC. We don't know yet how much the Cobham fees would be, if they need to support us past the enquiry stage. If the fees turn out to be unreasonably large, even when split over a group of scheme users such as ourselves, then that would be a problem obviously. In any case, the next step is probably a long wait... HMRC might drop the enquiries anyway, as in theory EBT loans were valid before Dec 2010.

                  Hi

                  I received the dreaded 08/09 letter a month ago,initially I tried to go through contractor helpdesk/cobham but had concerns about timescales of appeal.

                  My accountant lodged an appeal on my behalf approx 10 days ago & I am still awaiting a response

                  I am extremely worried about this as the amount requested is very large & only relates to part of my time with them.

                  I'd be very interested in hearing from others in the same position.

                      Covering things such as who he is (obviously), history of EBT schemes and HMRC investigations,
                      what to expect next and some mistakes to avoid.

                      If anyone would be interested in attending one in London, in the next couple of weeks. (or knows how to get a good deal on a hotel meeting room in London). PM me and I will try to co-ordinate
