    Need good advice (tax advisor)

    Hi, can anybody help me to choose a trustworthy tax specialist. I have been filling my own tax returns now and now have tax bill over £130k. My accountant has been raided by HMRC and he has shut down. No contact for past three months. I have talk to HMRC and they want every penny of Tax immediately, no concessions what so ever. Please PM me any good accountant / tax adviser details. Suraj

    You have not said in your original post that your tax liabilities are as a result of being in a Scheme, be it EBT or Loan or anything else. In fact it sounds as if your tax problems are as a result of poor accounting, NOT tax avoidance.

    I am under investigation by HMRC due to my accountant didn't advise me at all and i was sent loans from overseas. I filled my own returns and HMRC sent me a tax bill of £130k. Now i have received a COP9 letter and I am trying to find out how to submit the disclosure. I dont see any COP9 disclosures here on the forum but my worry is will it lead to imprisonment. Need help if someone can. Accountants I talk to dont quote fee but charge hourly and need a guarantor who can guarantee their fee as they see it may all fell on me and i may be prosecuted. Any relevant thread where i can get help.

      If you have a COP9 then you need legal help. If you want to stick with tax enquiry firms then you need to look for COP9 specialists as that is serious stuff.

      Any firm willing to take on the disclosure etc is likely to be charging by the hour as it's always uncertain how long the process may take. I'd be surprised if any firm would take you on for a fixed fee and deliver a decent result.

        That is because we have never had a thread with someone admitting to a COP9 until now.

        As webberg said - you need legal help, not just an accountant - you need a solicitor versed in these matters.

            I'll stick my neck out here and suggest that if you want legal help you go to Reynolds Porter Chamberlain.

            They have good knowledge of contractor schemes.

            If you want a tax firm who deal with COP9 then go to INTAX.

            InTAX LLP are specialists in tax investigations of all kinds

            They do not have any particular contractor experience but a lot of COP9 experience.

            (And no, I'm not connected with either and do not benefit from making a recommendation)

              However Webberg is a tax specialist rather than a contractor and does know what he is talking about. The consensus of posters on this forum would be to try and follow his advice...

                  Hi Suraj

                  Alongside Webber's suggestions, I used a firm called Cobham Murphy to help me with my EBT Loan mess. Had no complaints and they can handle a case up to an FTT - they are primarily Tax Consultants, but importantly they will liaise with HMRC on your behalf and get a fuller understanding of why you have a COP9, what points of Tax law you have fallen foul of, advise you of where you stand and if necessary and negotiate a settlement/Time To Pay etc.

                  Without knowing the ins and outs of your case, (which is probably why you haven't received much feedback from here - it would help the thread if you provided some basic details of the history of your case - was there a particular scheme promoter you used; roughly what happened - eg Contracted to a company that paid funds into an EBT and then trustee "paid" you in loans - a lot of experience of various schemes here, so help us to help you), its hard to judge exactly how much trouble you're in, but note that £130k on the COP9 you were issued may well be an estimate (especially in cases where HMRC are making an estimate based on things like P11Ds, and what you've already declared etc), so its very much worth going through and sorting all of your documentation from that period, Self Assessments, P11Ds, emails, Loan Agreements, Bank Statements, contracts you have signed etc etc and understanding exactly what money's you have received (as loans or otherwise) and then estimating the tax owed using various tax calculators that are on the web. Really important to get atleast a rudimentary understanding of your position before you engage a professional as they will waste hours establishing it for you which means £££s for something you can easily do yourself.

                    This is serious stuff indeed. I fear the OP is in extremely deep s**t. I have mixed feelings about this. Perhaps he was badly mis-advised by an accountant? Bottom line though, I fear this person's greed and naivety got the better of him. I doubt we'll hear much more of this, if I were advising him I'd tell him to quit public posts immediately. I hope others find this thread and take serious note if anyone else is trying to be just a little too clever with personal tax responsibilities.
