      Is that the TAA defence? Presumably that only applies to those that switched their CN appeal to TAA before the Huitson verdict came in.

        Once the FTTT verdict is in, you cannot change your defence.

        There is something on the De Graaf thread. Personally I am very sceptical. The reason being that this has been going on for over a decade. Its a very unfair situation and people are rightly very angry. Somewhere the line has to be drawn.

        I am sure there will be some who will carry on fighting.

        Each must decide what to do for the best in their own circumstances.

          Mr B Pad is correct in the main.

          Huitson has been lost and although there are some vague rumblings about the "retrospection" point being continued (presumably in ECJ) which may at some point have some bearing on the position, that has to be seen as an outside chance now.

          The TAA group continues to the best of my knowledge and following Rangers decision may now have a better chance. I think that group closed some time ago for new members but you could do worse than ask them?

          Mr Pad points out that we are looking at another idea that may impact the position but also that the chances of anything concrete coming from it is certainly no better than the chances of TAA Group although (in my opinion) perhaps better than the retrospection point. The issue we have, bluntly, is getting to the start line. So no guarantees.

          I think you need to contact HMRC and get your position clear. Once you know what it is, if you are going to be unable to cope with it financially, seek professional help from an insolvency specialist. If you want to continue the debate seek, help from a specialist.

            HMRC seem to be going after everyone in the Montpelier DTA scheme.

            Please be very careful not to incur any penalties.

            You may be told these can be challenged. You might want to think very carefully about that.

              My Representation has been rejected and it's the end for me.

              MTM have come back with a protest letter but I think that's futile.

              In terms of settling, what can I do as I was told I have to get the Corrective Action Forms (CAF) in as well. Penalties apply if I don't. Honestly, I've no idea what to put in there (CAF) ....short of asking HMRC what to do.

                You should ask HMRC what to put.

                Try to get a full and final settlement figure from them.

                It has been known for people to take CA then get penalty letters! Try to record all conversions with HMRC. And ask them to put everything in writing.

                  Zal- the CAF does not require any fancy reply. I just stated that I was willing to pay the APN and agreeable to settle the matter. They then write to you with what you owe including interest and you pay it. I found the process uncomplicated and not stressful.

                    Surely this is not settling the matter. This is just paying the APN for now and settle a different amount later?? I understood at the moment HMRC do not settle.

                      Is there a specific person I can speak directly to, who deals with this, at HMRC?
