    2011/12 Discovery assessments on their way

    It was widely expected and unsurprising but HMRC is preparing to issue a wave of discovery assessments for 2011/12 before the cut off on 5th April 2016.

    These will take in all those "schemes" that operated in that year, the majority of which were not DOTAS declared.

    It remains to be seen how efficient HMRC are in terms of identifying the taxpayers who used the schemes. However , if you did but do NOT get an assessment you may not escape as there is a longer 6 year limit that can apply if certain conditions are met.

    In the meantime, if you do get a discovery assessment be sure to appeal and ask for the tax to be postponed.

    At the moment a non DOTAS scheme which has a discovery assessment will not meet Condition C for an APN and so none can be issued. I can see unfortunately that this is an easily changed position however and the Budget in March may have something on this.

    Making an appeal and asking for postponement is straightforward and requires just a sensible letter within the 30 day limit. You can do this yourself.

    However agreeing the final liability is something that you will require some professional help with.
