    Dear Stu,

    Grant would like to thank you for your email regarding Early Day Motion
    1124, on Section 12 of the Finance Act 2000, commonly referred to as
    'IR35', and has asked me to respond on his behalf.

    Grant has received many emails on this topic and he fully appreciates
    your concern on this matter. However far from simplifying the tax system
    the creation of IR35 has brought about a significant series of
    complexities to the taxation system causing difficulty for all who are
    affected by it. In reality, there is a dramatic difference in taxation
    levels between those who are subject to IR35 and those who are not.

    The IR35 provisions, that the Government said they were introducing in
    order to prevent individuals avoiding tax and class one National
    Insurance Contributions, have been contentious ever since their
    introduction. Conservatives are concerned about the intentions behind
    IR35, but we must think carefully about how to resolve this complicated
    issue. It is not as simple as just abolishing the provisions altogether.
    It is on this basis that Grant has asked me to tell you that he cannot
    sign the motion.

    For a long time, Grant's colleague Mark Prisk MP, Shadow Minister for
    Business, has been consulting with freelance workers on the impact of
    IR35. Grant understands that, in the eyes of those it affects, it is an
    overly-complex tax mechanism, and it is an area that Grant and his
    colleagues wish to look into in more detail.

    Grant has made the Shadow Business team aware of your concerns, and he
    asked me to assure you that he will continue to review the IR35
    provisions.

    Front bench team won't sign any EDMs anyway. However the Tories are making it clear they are not making any policy-related decisions publicly (mostly because NL will immediately nick them and cock them up) and signing that EDM would be seen as a policy statement. Hence the stock answer. There are some good indications though that IR35 is doomed, although exactly how is not that simple; it's not like striking out one line of legislation, you have to undo several years of amendments to sub-clauses in various Finance Acts.

    So don't give up hope yet, the game is deeper than it may appear.

    Very excited to see that IR35 is nearing its death (hopefully)... I really think removing shackles from the contractor sector will be really good for the economy, not just the personal gain of contractors...

    Contractors just want a fair deal.... The government just doesn’t get it...

    What and punish New Labour for IR35 and it's handling of the economy, it's love of legislation and Big Brother monitoring of it's citizens, it's complete open border policy regarding immigration, poor standards in education and healthcare and it's love of putting it's own hand in the till to further it's own gain?
