    Company being TUPE, but no contract in place for contractors (it's a long one)

    Hi,

    Just a quick question, but first an explanation of the situation.
    I have been at my current gig since November, the company have lost the contract an are being replaced. The permies are being TUPE, last minute they realised there are contractors involved. A quick meeting is set up with us, finding out the usual what we're doing sites were covering an the rate we're on etc.
    We keep getting small extensions until the big day, so on Monday this week we're expecting to be given notice. All we receive was a quick VM saying we're being transitioned to a new company. As the week goes on it becomes apparent that the current agency, can't agree terms and still have a slice of the pie.

    So the current company will pay until the end of the month 31 July. Then it's the big take over. So we will be expected in to work on the 1st Aug, but there is no contract in place, no idea of rates notice periods etc. In fact apart from the mention that they want us for 6mths. No agency has yet approached us with anything.

    Now the big question!!!!
    Bear in mind the site is also a building site, do we go in on the Tuesday.

            Usually the old agency will have a contract clause saying you cannot work with client except through them for 12 months.....

              This is a grey area as the current agency hasn't got the work to offer so don't have any losses to chase any contractors for if they work with the other agency.

                They have played a blinda, they asked to pass on details. So no doubt will have charged for a finders fee.
                Its the usual last minute thing, ie don't worry about the contractors. Then think s*** we have lost our resources.
                All we have been given is they wish to offer a 6mth gig.....
