    Contractor Overtime

    Hi All,

    I am working for a X client though Y agency/vendor as a contractor/free-lancer. I am paid for the overtime (standard rates) all these days & recently I got to know that Client X is paying Y agency/vendor twice my standard rate. When I asked the same to be paid Y agency/vendor is denying. I feel I am being cheated as Y agency/vendor would get their commission double & they are also taking my portion. Please suggest on this.

    What does your contract say re overtime?

    If it says "paid at standard rates" then guess what? You're being paid correctly. That's the contract you signed with the agency. If you wanted double pay for overtime than that's up to you to negotiate with the agency.

    Agency are not getting "your portion". Agency are getting the money as per their contract with the end client.

        I agree. But that doesn't mean OP is helpless.

        He doesn't HAVE to work overtime. He can tell the agent he's not doing any more overtime unless they modify the deal. They won't want him to quit working overtime.

        Just don't be overly greedy. If you insist on double your pay for overtime when it isn't in your contract, they'll probably say forget it. If you say you are not working any more overtime unless they give you time and a half, chances are good they'll meet you half way. They'll still be making a killing on your overtime, but you'll be doing a lot better off of it than you are.

        You are running a business. You are providing a service, but you just found out the middleman is taking a huge cut in some cases, and it is services you are providing at your discretion. You aren't a slave. Do a deal, make sure it is still a big win for them but better for you than it is now, and you'll probably come out with a nice win-win situation. If they won't do a deal, don't do any more overtime. They'll likely come around.

          I'd also say that I'd be concerned if a role required regular overtime. Very occasionally, sure - and I don't always bill if it's a small amount of time, goodwill and all that. If it's regular expectation of working far more hours than normal professional day then there are other issues I'd be worried about.
