The treasury might argue that if they need a 2-3-5 year commitment from a 'temporary worker/company', they are actually employing that worker/company on a permanent basis. I think this is wrong, but it's harder to argue against.

They seem to accept that EDSs workers are temporary!
As I said before, they plain do not understand us (or do not accept us). They have set out to see us as employees and will twist the viewpoint to make it so.

Do they?
Does anyone know of a case where EDS employees have been claiming expenses and those expenses have been tax deductable/the tax hasn't been picked up by EDS when the employee has been on site for more than two years?

In fact, the officials of a Welfare State, perceiving that their jobs require a supply of "clients" needing State aid, eventually become adept at making sure that there are always people in need. To do this, they either adopt policies that promote poverty and dependence, or stretch existing classifications to bring more "clients" into the Welfare system.

That is out of context. We were discussing the view that a long term contract seems to be seen as temporary for EDS guys but not us. Not the 2 year rule at all.
HOWEVER
I suspect that when they change the rules on expenses it wont affect EDS guys.

Why is out of context?  If EDS guys can claim T&S, and it's tax deductable, then how are they evading the law as it stands now? There's 3 possibilities:
1. They're breaking the law
2. EDS are picking up the employees tax charge
3. They've found a way round
Further, it seems to me difficult to change the rules on expenses in such a way that EDS won't be affected, but we will.

However, you might find EDS's people are permies and have a genuine and easily recognisable home office. Which greatly simplifies the "remote location" question...

It is out of context because at that point we were not discussing expenses at all. Read the post I was responding to. We were pointing out that an EDS guy can be on site for as long as he likes and not be regarded as an employee of the client, he will never be subjected to an IR35 investigation yet a contractor could be regarded as such and may be investigated REGARDLESS OF WHETHER THEY CAN CLAIM EXPENSES.
I agree that it will be difficult to change the law to only touch us but you may note that the consultation only points to brollies and agents, not headlease companies.
