    If that was the case, then almost no contractor would be able to wind up their company and take a capital distribution unless they were retiring.

    It has already been established in letters from HMRC that taking up permanent employment would not count as continuing the same trade as activity, so no it wouldn't be the case. It would only become an issue if they returned to contracting within 2 years. A job is not a trade or activity.
