    Notice periods

    Hi,
    Does anyone know whether it is legal for a company to force you to leave prior to the end of your given notice period once you have given notice. ie you give the company written notice of your intention to terminate in 4 weeks time as per your contractual obligations and then they come back and say , well actually we want you to go after 3 weeks, and by the way were not paying you for the last week.

    If you feel it's not legal than sue. The consensus (and if you'd spent some time searching this site you'd have found out) is that it is legal, and you just have to suck it up.

    While you're at search the terms "mutuality of obligation" and "IR35".

      Use the term notice periods as this gets talked about a lot so lots of useful information. In terms of your situation, there is probably a clause in your contract that says you only get paid for completed time sheets. They don't offer you work, you have no timesheet, you don't get paid. Exactly same outcome.

      But do a search and read up and make your own mind up.

        Assuming you are talking as notice from a contract....?
        If so, then as NAT said, suck it up and move on - you cannot invoice if no work is done; they don't want any work done, hence no invoicing.

        Of course, if you are Mr(s) Permie (Wo)man, then you might have a case for claiming payment for the full notice period.

        What does your contract say?

                    It really will depend on how the specific contract is drafted. If the client has a shorter notice than yourself this may well be correct.

                    It does sound an unusual situation.
